Terms and Conditions for MagicResume

Welcome to MagicResume!

These Terms of Service ("Terms") govern your use of the MagicResume website at https://magicresume.top ("Service") and all related features. By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use MagicResume.

1. Description of Service

MagicResume is an AI-powered platform that helps job seekers create, optimize, and manage professional resumes. Our Service includes:

- AI-powered resume editing with PowerEdit suggestions
- Cover letter generation with multiple tone options
- Mock interview practice with AI feedback
- Job-fit analysis and ATS optimization
- Resume versioning (Git-like branching)
- LinkedIn profile import
- Analytics and performance tracking
- PDF export and public resume sharing

2. Account Registration and Eligibility

2.1 Age Requirement

You must be at least 16 years old to use MagicResume. By creating an account, you represent that you meet this age requirement.

2.2 Account Creation

You can create an account using:
- Email and password (magic link authentication)
- Google OAuth
- GitHub OAuth
- LinkedIn OAuth

2.3 Account Security

You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access

We are not liable for losses caused by unauthorized use of your account.

3. Subscription Plans and Billing

3.1 Free Tier

The free tier includes:
- 3 AI resume edits per month
- 1 cover letter generation
- Basic resume templates
- Watermarked PDF exports
- Limited interview practice
- Email support

3.2 MagicResume Pro ($49/month)

The Pro subscription includes:
- Unlimited AI resume edits
- Advanced cover letter generation
- Job-fit heat mapping
- Complete interview preparation suite
- Chrome extension (coming soon)
- PDF exports without watermark
- Multiple resume versions
- LinkedIn import
- ATS score calculator
- Priority support

3.3 Billing Terms

- Subscriptions are billed monthly via Stripe
- Payments are processed at the beginning of each billing cycle
- You authorize us to charge your payment method on file
- All fees are in USD and non-refundable except as stated in Section 4
- Taxes may apply based on your location

3.4 Subscription Management

You can manage your subscription through the Stripe Customer Portal:
- Update payment methods
- View billing history
- Cancel subscription
- Download invoices

3.5 Cancellation

- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- You will retain Pro access until the end of the paid period
- No partial refunds for unused time in the billing cycle

4. Refund Policy

4.1 14-Day Money-Back Guarantee

We offer a full refund within 14 days of your initial subscription purchase if you are not satisfied with MagicResume.

To request a refund:
- Type "refund" in our customer support chat, OR
- Email bartzalewskidev@gmail.com with subject "Refund Request"

Refunds are processed automatically within 5-7 business days.

4.2 Refund Exclusions

Refunds are not available for:
- Renewals after the initial subscription period
- Accounts found to be violating these Terms
- Accounts that have been used fraudulently

5. Acceptable Use

5.1 Permitted Uses

You may use MagicResume to:
- Create and optimize your own resumes
- Generate cover letters for your job applications
- Practice interviews for positions you're applying to
- Track your job search performance
- Share your resume with potential employers

5.2 Prohibited Uses

You may NOT:
- Use MagicResume to create resumes for others commercially without permission
- Share your account credentials with multiple people
- Scrape, spider, or crawl the Service
- Reverse engineer or decompile any part of the Service
- Use the Service to create fake, fraudulent, or misleading resumes
- Bypass or circumvent any access restrictions or usage limits
- Use the Service to harass, threaten, or violate the rights of others
- Upload viruses, malware, or malicious code
- Violate any applicable laws or regulations
- Resell or redistribute AI-generated content at scale
- Use automated tools to abuse free tier limits

5.3 Content Ownership and License

- You retain ownership of all content you create (resumes, cover letters, etc.)
- You grant us a limited license to use your content to provide the Service
- We may use anonymized, aggregated data to improve our AI models
- We will never sell or share your resume content with third parties without your consent

6. AI-Generated Content

6.1 AI Accuracy

While we strive for accuracy, AI-generated suggestions may contain errors. You are responsible for:
- Reviewing all AI-generated content before use
- Verifying factual accuracy of suggestions
- Ensuring your resume represents your actual qualifications

6.2 No Guarantee of Results

We do not guarantee that using MagicResume will result in:
- Job interviews or offers
- Increased application success rates
- Specific ATS scores

Results depend on many factors outside our control.

7. Public Resume Sharing

7.1 Public Links

When you make a resume branch public:
- Anyone with the link can view your resume
- The resume is hosted on our servers with a unique URL
- We track view counts and basic analytics
- You can revoke access at any time

7.2 Your Responsibilities

When sharing publicly, you are responsible for:
- Not including confidential or sensitive information
- Complying with applicable privacy laws
- Ensuring accuracy of information shared
- Managing password protection and expiration settings

8. Intellectual Property

8.1 MagicResume IP

We own all rights to:
- The MagicResume platform, code, and design
- Our AI models, algorithms, and proprietary technology
- Our brand name, logo, and trademarks
- All documentation and marketing materials

8.2 User Content

You own all rights to your resume content, cover letters, and interview responses. By using MagicResume, you grant us a non-exclusive, worldwide license to:
- Store and process your content
- Display your content back to you
- Use anonymized, aggregated data to improve our Service

8.3 Restrictions

You may NOT:
- Copy, modify, or distribute our software or code
- Create derivative works based on MagicResume
- Remove or alter any copyright notices
- Claim ownership of any MagicResume intellectual property

9. Third-Party Services

MagicResume integrates with third-party services:

- OpenAI (GPT-4): AI-powered features
- Stripe: Payment processing
- Google, GitHub, LinkedIn: OAuth authentication
- Vercel: Hosting
- MongoDB Atlas: Database
- Resend: Email delivery

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services' actions or policies.

10. Data Privacy and Security

10.1 Data Collection

We collect and process personal data as described in our Privacy Policy at https://magicresume.top/privacy-policy.

10.2 Data Security

We implement industry-standard security measures including:
- HTTPS/TLS encryption
- Encrypted database storage
- Secure authentication with NextAuth
- Regular security audits

However, no system is 100% secure. You use the Service at your own risk.

10.3 Data Retention

- Active accounts: Data retained indefinitely
- Deleted accounts: Data removed within 30 days
- AI cache: Automatically deleted after 24 hours
- Backup data: May persist for up to 90 days

11. Termination

11.1 By You

You may delete your account at any time through your account settings. Upon deletion:
- Your access will be immediately revoked
- Your data will be deleted within 30 days
- Active subscriptions will be canceled (no refund for partial periods)

11.2 By Us

We may suspend or terminate your account if:
- You violate these Terms
- You engage in fraudulent activity
- You abuse the Service or harm other users
- We are required to do so by law
- We discontinue the Service (with 30 days notice)

11.3 Effect of Termination

Upon termination:
- Your license to use the Service ends immediately
- You lose access to all data (download it first!)
- Outstanding fees remain due
- Sections 5.2, 6, 8, 12, 13, and 14 survive termination

12. Disclaimers and Limitations of Liability

12.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OF AI SUGGESTIONS
- UNINTERRUPTED OR ERROR-FREE OPERATION

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGICRESUME SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
- DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE
- DAMAGES RESULTING FROM THIRD-PARTY SERVICES

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12.3 Resume Content Disclaimer

We are not liable for:
- Inaccuracies in AI-generated content
- Resumes that fail to pass ATS systems
- Lost job opportunities due to resume errors
- Legal issues arising from false or misleading resume content

13. Indemnification

You agree to indemnify and hold harmless MagicResume, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any law or third-party rights
- Content you submit to the Service
- False or misleading information in your resume

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except:
- You may bring claims in small claims court
- We may seek injunctive relief in court

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive the right to participate in class actions or class arbitrations.

14.4 Informal Resolution

Before filing a claim, you agree to contact us at bartzalewskidev@gmail.com to attempt to resolve the dispute informally.

15. Changes to Terms

15.1 Notification

We may update these Terms at any time. When we make significant changes:
- We'll update the "Last Updated" date
- We'll notify you via email
- We'll display a notice on the Service

15.2 Acceptance

Continued use of the Service after changes constitutes acceptance of the new Terms. If you don't agree, you must stop using the Service and delete your account.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MagicResume.

16.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any right does not constitute a waiver of that right.

16.4 Assignment

You may not assign these Terms. We may assign them to any successor or affiliate.

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, wars, strikes, etc.).

17. Special Provisions

17.1 Stripe Climate

We contribute 0.5% of revenue to Stripe Climate to support carbon removal projects.

17.2 Chrome Extension (Coming Soon)

When released, the Chrome extension will be subject to additional terms specific to browser extensions and will integrate with job boards to provide:
- Automatic job description analysis
- One-click resume tailoring
- Fit score calculation
- Form autofill
